2024.07.23. The Fair Economy — The Fair Trade Commission said an amended enforcement decree of the Basic Act on Consumer Protection, which specifies the scope and methods of surveys needed to promote consumer rights or advance consumer policy efficiently and allows consumer dispute mediation meetings to be held online, passed the Gukmu Hoeui (State Council) on the 23rd.

The amendment is a follow-up measure to the revision of the Basic Act on Consumer Protection in February. It specifies the scope of surveys required for formulating consumer policy so that such surveys can be carried out smoothly.

First, it defines the scope of surveys to include matters concerning the transactions, prices, labeling and advertising of goods, as well as consumer damages related to such transactions. It also stipulates that the Fair Trade Commission must draw up a survey plan in advance when conducting a survey.

Additionally, the amendment established the legal basis for online consumer dispute mediation meetings.

Before the amendment, there was no separate provision for remote attendance, so meetings were held with all mediators attending in person (offline), which limited the prompt handling of cases. To improve and supplement this, the amendment clarified that meetings of the Consumer Dispute Mediation Committee can also be held via remote video conferencing.

The amendment, which passed the State Council, is scheduled to take effect on Aug. 14 after it is promulgated upon presidential approval.

The Fair Trade Commission said it expects that this amendment to the Enforcement Decree of the Framework Act on Consumers will ultimately strengthen the effectiveness of consumer policies and improve the efficiency of the consumer dispute mediation system.
