2024.08.14. The Fair Economy — Evaluation standards will be established to allow the application of contracts by negotiation (negotiated contracts) to public technical service projects as well.

The Public Procurement Service pre-announced on the 13th a revision to the 'Public Procurement Service Detailed Standards for Proposal Evaluation for Contracts by Negotiation' containing these contents.

The Public Procurement Service explained that the purpose of the revision is to improve the proposal evaluation method in order to reduce the burden on companies and enhance the expertise, fairness and transparency of evaluations. Specifically, it includes the introduction of a specialized evaluation system for large software (SW) projects, real-time disclosure of evaluations, and raising the threshold amount for proposal presentations, among other measures.

It also includes provisions introducing the negotiated contract method in the technical services sector as well, in response to the increase in public demand incorporating diverse services driven by advances in information and communication technology (ICT).

Looking at the key contents, the negotiated contract method will be introduced in the technical services sector. To allow negotiated contracts to be pursued for technical services as well, the scope of application of these detailed standards will be expanded from the existing goods and general services to goods and services, and new detailed evaluation standards will be established.

A specialized evaluation system for large SW projects will be introduced. When requested by a demanding agency, a new system will be created in which a 'Specialized Evaluation Committee' formed to reflect the characteristics of the relevant SW project evaluates specialized evaluation items. Among large SW projects, ▲information technology development, ▲information security, ▲data construction and ▲digital technology, among others, were designated as subjects of specialized evaluation.

A legal basis will be established for the Public Procurement Service to conduct proposal suitability evaluations on behalf of agencies for private contracts concluded after a re-announced bid fails to attract bidders. A provision will be established allowing the Public Procurement Service to act on behalf of demanding agencies when they request a suitability evaluation of proposals for private contracts, and the scope of such representation will be specified in detail.

Proposal evaluations will be disclosed in real time through means such as YouTube broadcasts. A new provision will be established stipulating that companies that do not submit a consent form for real-time disclosure will be evaluated based solely on their submitted proposals.

Provisions will be established to clarify the procedure for determining false content and to minimize the disparagement of other companies. For fair bidding, the procedure for determining falsified documents will be clarified, and penalties will be imposed when content disparaging other companies is included in proposals or presentations. Determinations on false content and its impact on bidding results will be made through internal deliberation, and when disparagement of other companies occurs, evaluators will assess whether such disparagement took place and deduct up to 0.1 points from the technical capability evaluation.

The threshold amount for proposal presentations will be raised. To reduce the burden on companies of preparing presentation materials, the threshold amount for proposal presentations will be raised from the publicly notified amount of 220 million won to 500 million won or more.

Payment of allowances to evaluation committee members will be rationalized. Allowances will be paid according to the payment bracket to which a majority of evaluators belong; in the case of a tie, allowances will be paid according to the bracket to which the evaluators belong.
