2024.09.05. The Fair Economy — The government has begun the process of transferring the existing National Security Research Institute to the National Security Technology Research Institute. The management authority will also be unified under the National Intelligence Service, moving from the current dual system of the Ministry of Science and ICT and the National Intelligence Service.

The National Intelligence Service announced on the 5th a draft bill to establish the National Security Technology Research Institute.

The National Intelligence Service noted that securing technology to counter security threats arising from new technologies such as artificial intelligence (AI) and quantum is emerging as an essential element of national security, and judged that it is urgent for national security agencies to promptly acquire relevant technology to respond agilely to rapidly changing security environments.

However, the NIS noted that securing technology through the private sector is limited due to the high level of security required for security technologies. It also pointed out the lack of specialized research institutions capable of developing sensitive technologies in close coordination with national security agencies, making it urgent for the government to formulate a response strategy for future national security.

National security technologies are being researched and developed at the "Electronics and Telecommunications Research Institute" subsidiary under the Ministry of Science and ICT, but the management system is dualized between the National Intelligence Service and the Ministry of Science and ICT, making it difficult to fully utilize research capabilities, and it was also judged that there are limitations in meeting the nation's security technology needs.

Accordingly, the NIS explained that it aims to establish the 'National Security Technology Research Institute' by transferring the affiliated laboratory of the Electronics and Telecommunications Research Institute from the Ministry of Science and ICT to the National Intelligence Service, a national security agency. This is intended to improve the national security technology research and development system and double the specialization of the security technology research institution.

It also said it would clarify the duties of the National Security Technology Research Institute, include provisions on the composition of the board of directors and matters concerning the president and executives in the draft act, and prepare efficient operation plans for the institute.

Furthermore, it stated that the legislation will allow for the provision of contributions to cover the expenses necessary for the establishment, research, and operation of the National Security Technology Research Institute, and that the institute must submit its business plan and budget to the head of the National Intelligence Service before the start of each fiscal year, among other provisions necessary for its operation.

Looking at the main contents of the draft act, it clearly states the purpose (Article 1) of conducting research and development and technical support in science and technology fields necessary for national security and the protection of national interests.

The establishment of the National Security Technology Research Institute (Articles 2 and 4) will be as a legal entity. The location of its main office will be determined by its articles of incorporation, and it may establish affiliated institutions or branches as prescribed in the articles of incorporation.

Regarding the composition of executives (Articles 7 and 8), there will be up to 15 directors including one chairman and one president, and one auditor, with duties and other necessary matters determined by the articles of incorporation, and a board of directors will be established to deliberate and decide on important matters of the institute.

Provisions for securing operational funding (Article 11) are also included. The government may provide contributions to cover expenses for the establishment, operation, and research of the National Security Technology Research Institute.

Regarding the submission of business plans and other documents (Article 14), the National Security Technology Research Institute must submit its business plan and budget to the head of the National Intelligence Service for approval before the start of each fiscal year.

Autonomous management and guarantee of external cooperative research (Articles 6 and 19) are also included in the draft act. The government guarantees the independence and autonomy of the institute's research and management, and ensures maximum research cooperation and academic exchange with domestic and foreign universities and research institutions.

There are also provisions on the closure of the National Security Research Institute and its succession by the National Security Technology Research Institute (Articles 5 to 8 of the Addenda). The National Security Research Institute is deemed closed upon the establishment of the National Security Technology Research Institute, and employees of the former National Security Research Institute are deemed to have been hired as employees of the new institute on the date of its establishment registration. The National Security Technology Research Institute also succeeds all budgets, rights, and obligations of the National Security Research Institute.
